Limited Warranty
Terms and Conditions
This Warranty Certificate sets forth the terms and conditions to which the manufacturer of your Solis Notebook Computer (COMPAL) will provide 'Depot' services ('Services') on the specific equipment ('Equipment') noted as eligible for 'Depot' warranty service on the invoice ('Invoice'). Services shall consist of labor and parts rendered by COMPAL or its authorized service provider necessary to restore the Equipment to normal operating conditions in accordance with Equipment specifications and/or descriptions.
Term
This Warranty shall commence upon the Purchase date and shall continue for twelve (12) months.
Services Provided
The Services provided thereunder are only available for the specific equipment as indicated on the invoice. COMPAL or its authorized service provider including BIZCOM or others shall use all reasonable efforts to perform Services, but will not be responsible for delays or failures in performance when due to causes beyond its reasonable control. Replacement parts will be provided by COMPAL, (or at their option, MidWest Micro may ship replacement parts on their behalf) without charge and shall be either new or reconditioned or reassembled parts which are equivalent to new. All replaced parts shall become the property of COMPAL. COMPAL or its authorized service provider reserves the right to charge Customers at COMPAL's then current rates for consumable parts or other parts required by customer such as batteries, mice, speakers, microphones, paper products, ribbons, bulbs, toners, batteries, burned phosphor in CRT's and fuses. Services shall be provided during the Term from 8:00 a.m. to 5 p.m., Monday through Friday, exclusive of statutory holidays ('Covered Hours').
Service Limitations
The following services are outside the scope of Services and will, upon Customer's request, be furnished by COMPAL on an as-available basis at COMPAL or its authorized service providers' then-current time and materials charge: (a) repairs, replacements or adjustments or increased service time required as a result of improper installation or software setup (unless by COMPAL); (b) any cause external to the Equipment, including but not limited to any act of God, lightning or power surges, issue, abuse, negligence, accident or failure to maintain the proper operating environment; (c) modification, alterations, attachments or services made or performed by persons other than COMPAL or its authorized service provider; (d) use of equipment, programs, attachments or devices not approved by COMPAL; and (e) repairs, replacements or adjustments or increased service time due to software or software viruses.
Warranty Limitation
There are no other warranties or conditions respecting the equipment, express or implied, if any, are limited to the duration of the express warranty provided herein.
Customer Obligations
The Customer must maintain the Equipment in a good operating environment, including proper electrical supply, in accordance with manufacturer's instructions, including cleaning. The customer shall be responsible for all proper packaging, freight and insurance charges to COMPAL's authorized depot location. Customer shall be solely responsible for adequate backup of all files on a daily basis.

Out-Of-Scope Services
Any other services performed by COMPAL at the Customer's request which are outside the scope of Services or travel surcharges for any Customer shall be separately invoiced by COMPAL or it's authorized service provider and paid within ten (10) days of Customer's receipt of the invoice.
Limitation Of Liability
In no event shall COMPAL or MidWest Micro be liable for any accidental, special or consequential damages, including but not limited to loss of use, loss of data, loss of business or profits. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
General
The Customer may not assign this Certificate without COMPAL's prior written consent. All notices hereunder shall be in writing addressed to the parties at their respective addresses set forth on the invoice. This Certificate is the complete agreement between the parties with respect to its subject matter and supercedes all prior or contemporaneous agreements, promises and proposals, whether oral or written, between the parties. No terms or conditions hereof shall be deemed waived and no breach or default excused unless such waiver or excuse shall be in writing and signed by the party to be charged. In the event that one or more provisions contained in this Agreement should be held to be unenforceable, its unenforceability shall not affect any other provisions of the Agreement.
Please keep this document in a safe place for your reference. This warranty gives you specific rights, and you may have other rights which vary from state to state.
